BACKGROUND/SUMMARY:  The scope of work was to establish a contract with a qualified contractor(s) to furnish all labor, supervision, materials, and any incidentals necessary for one walk-in freezer and one walk-in refrigerator for a complete and finished project at Governor Thomas Johnson Middle and Urbana High School.  No bids were received.  Staff reached out to some of the vendors, post-bid.  It was found that the vendors were unable to accommodate aspects of the bid and therefore did not submit a proposal.  Staff will pursue other avenues to facilitate these purchases.

PURPOSE OF PRESENTATION:  Staff is seeking the Board of Education of Frederick County (BOE) approval of the Memorandum of Understanding (MOU) between FCPS, Frederick County Government, and the Maryland Stadium Authority (MSA).  Once executed by all parties, this MOU will allow FCPS to seek reimbursement from MSA of State allocations for the Green Valley Elementary School (GVES) and Valley Elementary School (VES) replacement projects.

 

BACKGROUND/SUMMARY: Maryland’s Built to Learn (BTL) Act passed in March 2020.  This Act provides up to $2.2 Billion in additional funding for school construction projects throughout the state.  FCPS expects to receive up to $91 million dollars in funding over several years.  Maryland public school construction projects that are approved by the State of Maryland, and began construction after June 1, 2020, are eligible to request funding through the Built to Learn Act.  If approved by the Interagency Commission on School Construction (IAC) and MSA, each project seeking reimbursement of State funds through the BTL will require an MOU executed by all three parties.  Access to BTL funds will allow FCPS to get reimbursed on capital projects much faster than the usual three to five years under the traditional CIP process.  The BOE already approved the MOU for reimbursement for the Waverley Elementary School project in September 2022, and the Brunswick Elementary School project in January 2023.  This MOU for the GVES and VES replacement projects will allow FCPS to continue with the design and construction of both projects simultaneously.  FCPS will submit progress billing to MSA for reimbursement as the projects progress through design and construction.  

 

PROCESS STATEMENT: FCPS staff have been working with MSA staff over the past few months to review the language for the MOU.  The terms of the MOU have been reviewed by FCPS outside legal counsel on behalf of FCPS.  Frederick County Government has also completed their review of the MOU and their proposed edits that have been incorporated. 

 

Staff recommends approval of the MOU. Once approved by the BOE, the MOU will be sent to Frederick County Government for their review and approval.
